Healthi 8-Week Weight Loss Training Programme

Terms and Conditions for the money-back guarantee offer:

1. Eligibility Criteria:
The eligibility criteria for the money-back guarantee are as follows:

1.1. The money-back guarantee only applies to a participant who has enrolled and paid up in full for the 8-week Weight Loss Training Programme offered by Healthi (Pty) Ltd.

1.2. The participant must attend all scheduled sessions and ensure that they have sufficiently completed the online attendance register to verify their attendance.

1.3. The participant must complete all assigned activities and provide evidence that they have completed each activity by the specified time.

1.4. The participant must follow the programme guidelines.

1.5. The participant must disclose all medical conditions, including those that might affect weight loss.

2. Goal Setting:

2.1. The participant must set specific, measurable, achievable, realistic and timebound (SMART) weight loss goals at the beginning of the programme.

2.2. These SMART goals should be agreed upon, approved by the training facilitator and documented.

2.3. The participant declares that they have consulted with their medical practitioner prior to the commencement of this course and indemnifies Healthi against any loss, harm or damages suffered as a result of partaking in the programme without their medical practitioner’s prior approval, where necessary.

3. Timeframe:

3.1. The guarantee is valid for the duration of the 8-week training programme only.

3.2. The course schedule specifies the start and end date of the training programme.

4. Documentation and Tracking:

4.1. The participant is required to keep records of her, his or their progress, including weight measurements, dietary logs, and exercise journals.

4.2. This documentation will be requested to validate their claim for a refund.

5. Attendance and Participation:

5.1. The participant must attend all scheduled sessions and actively participate in all aspects of the programme.

5.2. Failure to attend or engage will disqualify the participant from the money-back guarantee.

6. Consultation and Support:

6.1. The participant must seek guidance from the training facilitator if she, he or they encounter challenges or obstacles during the programme.

7. Refund Request Process:

7.1. The participant requesting a refund must submit a written request along with supporting documentation and evidence of their progress or lack thereof within 7 (seven) days after the 8-week programme has completed.

7.2. The participant must provide the following evidence:

i. a copy of the participant’s personal development plan that has been approved by the training facilitator
ii. evidence that the participant received approval from their medical practitioner to lose the specified goal weight
iii. evidence that the participant declared all her, his or their medical conditions prior to programme commencement
iv. a copy (written or video recordings) of all the assigned activities completed with valid time stamps, evidence that all sessions were attended (they have sufficiently completed the online attendance register to verify their attendance).

7.3. The written request must be addressed to the Manager of Healthi (Pty) Ltd and emailed to info@healthi.life

8. Refund Amount:

8.1. The participant will be refunded for the full programme fee.

8.2. A non-refundable processing fee of R500.00 must be paid by the participant to Healthi before the refund can be processed.

9. Timeframe for Refund Processing:
It will take 30 (thirty) business days to process a refund once a valid request is received and approved.

10. Cancellation or Termination:
If a participant voluntarily withdraws from the programme before its completion, she, he or they are not eligible for a refund.

11. Dispute Resolution:
The Parties shall first use reasonable endeavours to resolve any disputes that may arise under this Agreement through good faith negotiations. This entails one of the Parties inviting the other in writing to meet, either in person or by means of telephone or video conferencing facilities and attempt to resolve the dispute within 5 (five) Business Days from date of written invitation. In the event that such negotiations do not result in a mutually acceptable resolution within 5 (five) Business Days of the commencement thereof, the dispute shall be handled in accordance with the rules of the AFSA. Both parties consent to conduct any arbitration proceedings within the Johannesburg area.

12. Programme Changes:
The programme content or schedule may be subject to change, but any such changes will not affect the validity of the money-back guarantee.

13. Disclaimer:
Healthi (Pty) Ltd, its staff and any subsidiary associated with Healthi (Pty) Ltd, do not take
responsibility for, nor will they be held liable for, any loss or damages incurred as a result of any
medical conditions, health ailments, mental illness conditions, loss of life, illness, injury and or
accident incurred by the participant for the duration of their participation on the 8-week weight
loss programme and its related activities. The participant assumes any liability which may arise or
result from the 8-week weight-loss programme and its related activities.

14. Termination of Guarantee:
Healthi (Pty) Ltd reserves the right to terminate the money-back guarantee if a participant violates programme rules, submits fraudulent supporting documentation or evidence, or engages in any other fraudulent activity.

15. Legal Jurisdiction:
The terms and conditions of this agreement shall be read in accordance with, and enforceable in
accordance with, the laws of the Republic of South Africa.

16. Communication:
Healthi (Pty) Ltd will communicate any changes to the terms and conditions to participants during
the programme.
